The rules made hereunder are the amended provisions equivalent to electronic documents/records in various statutes as amended by the information technology act, 2000. This privacy policy is free of any authorization and does not need any physical, electronic or digital signature. This privacy policy is a legally binding document between you and MED365 entities (both terms defined below). The terms of this privacy policy will be effective upon your registration on the website/app (as defined below) and will govern the relationship between you and the MED365 entities for your use of the website. This document is a declaration and shall be construed in accordance with the provisions of the Information technology rules, 2011 (reasonable security practices and procedures and sensitive personal data or information); that require issuing of the privacy policy for collection, use, storage and transfer of personal information including sensitive personal data or information.

    1. By registering the account on our website/app, you indicate that you understand, agree and consent to this privacy policy. If you do not agree with the terms and conditions of this privacy policy, please do not use this website/app. You hereby comply with an unconditional consent with MED365 entities as provided within the information technology act, 2000 and is in relevance to the rules and regulations amended therein. By giving us access to your Information or by using the services provided by the Website, You hereby agree to the collection, recording, processing, and transfer of any or all of Your Personal Information (as defined below) and Non-Personal Information (as defined below) by MED365, as mentioned under this privacy policy. You further accord that such collection, storage, use and transfer of any of your information shall not cause any loss or wrongful profit to you or any other individual. The terms “We” / “Us” / “Our” individually and collectively refer to each entity being part of the definition of Med365 Entity and the terms “You” / “Your” / “Yourself” refer to the users. This Privacy Policy is a contract between you and the respective Med365 Entity whose Website/app you use or access or you otherwise deal with. This Privacy Policy shall be read together with the respective terms of use or other terms and conditions of the respective Med365 Entity and its respective website/app or nature of business of Med365.

    2. The Med365 Entity has provided this Privacy Policy to make you familiarize with:
      1. The type of data or information that you share with or provide to any Med365 Entity, and that any Med365 Entity collects from you;
      2. The purpose of collection and usage of such data or information from you.
      3. The information security practices and policies of the Med365 Entities.
      4. The policy of the Med365 Entities on sharing or transferring your data or information with third parties.

    3. Amendment of Privacy Policy
      This Privacy Policy can be amended/updated from time to time as and when needed. We will pre-inform you of any amendment of, or modification to, the Privacy Policy, as is required under applicable laws.

      1. Information collected and storage of Information
        The “Information” (which shall also include data) provided by you to a Med365 Entity or collected from you by the Med365 Entity may consist of “Personal Information” and “Non-Personal Information”.
        Personal Information Personal Information is the Information collected that can be used to uniquely identify or contact you (the individual). Personal Information for the need of this privacy policy shall include, but not be restricted to:
        1. Your user name and your password.
        2. Your name, address, Phone number, e-mail address or other contact information;
        3. Your date of birth.
        4. Your gender.
        5. Information relating to your transactions on the Website/app, including but not limited to attempted transactions, sales or purchase history, etc.
        6. Your internet protocol address.
        7. The identification code of the communication device which you use to access the Website/app or otherwise deal with any Med365 Entity.
        8. Any other data/information provided by you while registering on our website.
        9. Your contacts/Phone Book
        10. Information presented by you with respect to, know your customer norms, either as part of our internal policies and as may be required under the respective applicable laws.

          1. Any other related Information falling within the curve of ‘sensitive personal information or data’ is defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 entitled under the Information Technology Act, 2000.
          2. Such Personal Information is obliged to be collected for the various purpose, which includes the course of you:
            1. Registering as a user on the Website/app;
            2. Registering as a merchant on the Website/app;
            3. Availing certain services offered on the Website/app. This includes, but are not limited to, communicating with the customer service of any Med365 Entity by phone, email or otherwise, making or participating in an online survey or contest, or posting user reviews on the services/items available on the Med365 Website;
            4. Otherwise doing business, transacting payment or attempting to transact and monetary value on the Website/app; or
            5. Otherwise dealing with any of the Med365 entities.
      2. Non-Personal Information
        1. The Med365 Entities may also collect information other than Personal Information from you through the Website/app when you visit and/or use the Website/app. Such information may be stored in server logs. This Non-Personal Information would not assist the Med365 Entities to identify you personally.
        2. This Non-Personal Information may include:
          1. Your geographic location;
          2. Information related to your telecom service provider/internet service provider;
          3. The usage of the browser (Firefox, Internet Explorer, Google Chrome, Opera, etc.);
          4. The operating system installed in your system or device and the Website You visited last before visiting the Med365 Website/app; or
          5. Clickstream data related to your activities on the Website/app, this is inclusive but not limited to the duration for which you stayed on the website/app, time and date of Your access to the Website.
        3. Non-Personal Information is collected through various ways such as the use of cookies. The Med365 Entities may store temporary or permanent ‘cookies’ on your computer. You can remove or choose to block these cookies from your browser settings or computer settings. You can set your computer’s browser to send pop up notifications when we attempt to send you a cookie with an option to refuse or accept the cookie. If you had set your cookies settings off, you may be prevented from using certain features of the Website;

        4. Advertisements: The Med365 Entities may use Third Party Service providers to serve advertisements on behalf of the Med365 Entities across the internet and sometimes on the Website. They may access Non-Personal Information related to Your Website/app visit, and your browsing history with respect to our products and services on the Website. Please do note that Personal Information and Non-Personal Information may be treated differently as per this Privacy Policy.
      3. Representations and Warranties
        You hereby represent to the Med365 Entities that, at all times during your registration with us:
        1. The Information you are supposed to provide to the Med365 Entities shall be legally authentic, and updated. You have all the permissions, rights and consents so as to provide the required Information (including Information related to any third parties) to the Med365 Entity; and
        2. Your providing the Information to the Med365 Entities and the consequent records, usage, collection, access transfer, or processing of the information by the Med365 Entities shall not be in breach of any third party agreement, charter documents, laws, judgments, decrees and orders. The representatives, directors, contractors or agents of the Med365 Entities shall not be responsible for the authenticity of the Information that you or any other user choose to provide to any of the Med365 Entities.
      4. . Purpose of collecting, using, storing and processing Your Information
        1. The Med365 entities reserve the right to collect, use, store and process Your Information for any purpose that may be permissible based on the consent obtained from You and is permissible under the applicable laws (this includes the applicable laws that permits for such collection, storage, usage, or processes in alignment with the consent of the user) in connection with a function or activity of any of the Med365 Entities. Such purposes (“Purposes”) are hence included but are not limited to:
          1. Facilitating your use of the Website/App or other services of Med365 Entities;
          2. Answering to Your inquiries or fulfilling the request made for the information regarding the various services and products offered on the Med365 Website/App;
          3. Providing you with information about products and services available on the Website/app and sending you information, materials, and offers from the Med365 Entities;
          4. Communicating you all the important information regarding the Website/app, changes in user agreements, terms and conditions, and policies and/or other administrative information;
          5. Sending You surveys and marketing communications that the Med365 Entities believe may be of interest to you;
          6. Personalizing your experience on the Website/app by displaying offers, advertisements, and products tailored to your choice and preferences;
          7. Taking into consideration your problems with the Website/app including any technical problem you come across.
          8. If you purchase any product or avail any service from the Website/app, completing and fulfilling your purchase. For example, any payment under process, communication regarding your purchase, and assisting you with the related customer service;
          9. Properly administering the Website/app;
          10. Performing internal reviews with the team and data analysis for the Website/app (i.e., to know the number of visitors on specific pages within the Website);

Assisting with value added services such as one entity Sign-On. “Single entity Sign-On” shall mean a user authentication process or session does allow a user to enter his/her name/mobile number/e-mail address/any combination therefore and password in order to have access to the multiple websites and applications;
          13. Facilitating various initiative and programs started and conducted by Med365 Entities by themselves or in collaboration with Third Party Service Providers or corporates/Banks;
          14. Analyzing the way our services are used, to measure the effectiveness of advertisements displayed, and to facilitate payments;
          15. Conducting academic research and surveys;
          16. Protecting the integrity of the Website/app;
          17. Replying to judicial, quasi-judicial process, and legal entities, to provide information on law enforcement agencies and in connection with an investigation for the matters concerning public safety, as permitted by law;
          18. Conducting analytical studies on various aspects including user behavior, user preferences etc.
          19. Allowing third parties to contact users that bought products from the Med365 Website/app to facilitate services such as installation or any other support related to the product.
          20. Implementing information security practices;
          21. ) Identifying computer contaminant, security breaches, or computer virus;
          22. Preventing, Investigating and taking actions related to suspected frauds and illegal activities;
          23. Undertaking forensics of the concerned computer resource as a part of an investigation or internal audit;
          24. Detecting computer resources or any person who may have breached, or is suspected of having or being likely to breach, including the Information Technology Act, or any provision of law, 2000 is likely to have an adverse impact on the services provided by Med365 entities or on any Website/app ;
          25. Enabling a potential buyer or investor to evaluate the business of the Med365 Entities; or
          26. sharing or transfer of such data in the event of any merger, acquisition, reorganization or sale of assets or business of the Med365 Entity to a third party or in the event of bankruptcy of the Med365 Entities.

          27. You hereby acknowledge and agree that the Information collected is for legal purpose, associated with a function or activity of each of the Med365 Entities or any individual on their behalf, and to fulfill the purpose, the collection of information if required.
      5. Storage and Processing of Your Information
        1. Your Information will predominately be stored in the electronic form. However, particular data may also be recorded in physical form.
        2. We may use the stored, collected, and processed data in countries other than the Republic of India. This is to the extent permitted under the applicable laws.
        3. We may enter into mutual agreements with third parties (in or outside of India) to record or process Your Information. These third parties may have their own security benchmarks to protect Your Information and we will, on a commercially viable basis, require such third parties to adopt reasonable security standards to protect Your Information, as required by the applicable laws.
      6. Sharing and disclosure of Your Information
        1. You hereby unconditionally agree and permit that the Med365 Entities may transfer, share, disclose or part with all or any of Your Information, within and outside of the Republic of India to various Med365 Entities, Third Party Service Providers / Partners / Banks and Financial Institutions for one or more of the Purposes, government agencies upon directions of such agency, or to the other third party as it could be required under the applicable law. In case of any Personal Information, therefore, is transferred, shared, disclosed or parted with, we will contractually oblige the receiving parties of the Information to ensure the same level of data protection adopted by the Med365 Entities is adhered to by the receiving party, subject to applicable law.
        2. You hereby acknowledge and agree that, to the extent allowed under applicable laws, it is adequate that when the Med365 Entities transfer Your Information to any other entity within or outside your country of residence, such Med365 Entities will place contractual obligations on the transferee and will oblige the transferee to stick to the provisions in this Privacy Policy.
        3. The Med365 Entities may disclose/transfer/ share the non-personal Information to any third parties who support Our business, such as providing technical infrastructure services, analyzing how Our services are used, analyzing how effective the advertisements are, facilitating payments, conducting academic research and surveys, or providing customer/buyer services, Such transferees shall stick to confidentiality obligations and are consistent with Med365 Privacy Policy.
        4. Nevertheless the above, We use other third parties such as a credit/debit card processing companies, payment gateways, pre-paid cards etc. to provide you the comfort to make payments on the website/app for availing services or buy products on the Website. When you are signing up for these services, you can also save your card details for future reference and faster payments. In such case, we may have to share your relevant Personal Information as mandatory for the third parties to provide such services, including your name, residence address and email address. The processing of payments and authorization is strictly in accordance with these third parties’ policies, terms and conditions and we are not in any manner accountable to you or the third party for any delay or failure at their end in the processing of the payments.

The Med365 Entities may also share Personal Information with such third parties to whom such Med365 Entities believe it is necessary to do so in order to investigate, prevent, or take action related to the illegal activities, situations involving potential threats to the physical safety of any person, suspected fraud, violations of any of the terms and conditions or Our policies.
        6. We hereby reserve the authority to disclose Your Information if needed, by law or regulation, or under any legal obligation or order under law or in response to a request from a law of enforcement by governmental agency or judicial, quasi-judicial or any other statutory or constitutional authority or to establish or exercise Our legal rights or defend against legal claims.
        7. You additionally agree that such revelation, sharing, and transfer of Your Personal Information and Non-Personal Information shall not cause any unjustified loss to You or to any third party, or any wrongful gain to Med365 or to any third party.
      7. Security & Retention
        1. We care for the security of your personal information. The Med365 Entities strive to ensure the security of Your Personal Information and to protect Your Personal Information against unauthorized access or unauthorized alteration, disclosure or destruction. For this purpose, the Med365 Entities adopt internal reviews of the data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where the Med365 Entities store your Personal Information. Each of the Med365 Entities shall adopt reasonable security practices and procedures as mandated under applicable laws for the protection of Your Information. Given that, your right to claim damages shall be limited only to the statutory damages under Information Technology Act, 2000, and you hereby waive and release all Med365 Entities from any claim of damages underneath contract or underneath wrongdoing, to the extent permissible under applicable laws.
        2. The Med365 Entities may share Your Information with third parties under a confidentiality agreement which inter alia provides that such third parties shall not disclose the Information further unless such disclosure is for the Purpose. However, the Med365 Entities are not responsible for any breach of security or for any actions of any third parties that receive Your Personal Information. The Med365 Entities are not liable for any loss or injury caused to you as a result of you providing Your Personal Information to any third party (including the third party websites, or if links to any third party websites are mentioned on the Website).
        3. Notwithstanding anything mentioned in this Policy or elsewhere, to the extent is permissible under applicable laws. The Med365 Entities shall not be held responsible for any loss, damage or misuse of your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below).
        4. A Force Majeure Event shall refer to any event that is beyond and beside the reasonable control of the Med365 Entities, this includes, without limitation, acts of God, sabotage, fire, explosion, flood, insurrection, strikes or industrial action of any kind, civil commotion, riots, war, acts of government, unauthorized access to computer, computer hacking, computer system or computer network, breach of security and encryption (provided beyond reasonable control of the Med365 Entities), computer crashes, power or electricity failure or unavailability of adequate power or electricity.
        5. Whereas we are going to endeavor and take all rational and appropriate steps to keep secure any Personal Information which we hold about you and prevent unauthorized access, You acknowledge that the internet or device networks are not fully secure and that We cannot provide any absolute assurance concerning the safety of Your Personal Information.
        6. You agree that all Personal Information shall be retained till the time required for the purpose or required under applicable law, whichever is later. Non-Personal Information will be retained indefinitely.
